Terms of Service

1. Acceptance

By creating an account, accessing, or using DrawTrust (the "Service") you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time as described below; the "Last updated" date above indicates the most recent revision.

2. What DrawTrust is

DrawTrust is a neutral verification platform for drawings, giveaways, and similar prize-selection processes. It allows organizers to register a participant pool, conduct a verifiable winner selection, and provide participants with an independent way to confirm their inclusion in the pool that was actually drawn from.

DrawTrust does not operate, manage, promote, fund, or insure your drawing. We provide verification infrastructure only and make no representation about the legality, accuracy, or outcome of any drawing run through the Service.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account. By registering you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. The Service is not directed at children.

4. Account security and accuracy

You are responsible for keeping your account credentials secure and for all activity that occurs under your account, whether or not authorized by you. You must not share your credentials, transfer your account, or allow another person to use it. You must provide and maintain accurate, current, and complete account information. Notify us immediately at the contact address below if you suspect unauthorized access.

5. Acceptable use

You agree not to:

  • Use the Service for any activity that is unlawful in your jurisdiction or any jurisdiction in which participants reside, including any activity requiring monetary consideration from participants where such consideration would render the activity unlawful.
  • Upload, paste, or otherwise submit data that you have no lawful basis to disclose to us, that infringes third-party rights, or that violates applicable privacy or anti-discrimination law.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service except to the extent expressly permitted by law.
  • Scrape, crawl, or systematically harvest data from the Service, or interfere with its operation, security, or integrity.
  • Circumvent rate limits, authentication, access controls, or other technical measures.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Create accounts in bulk or by automated means, or operate multiple accounts to evade enforcement actions.
  • Use the Service for any purpose prohibited by our brand and content rules, including activities described using terminology we have indicated is not permitted on the Service.

6. Organizer warranties and indemnification

If you create or run a drawing as an organizer you represent and warrant that: (a) you have a lawful basis under applicable law — including Lebanese Law No. 81/2018 on Electronic Transactions and Personal Data and the EU General Data Protection Regulation where applicable — to collect any participant data you submit and to disclose it to DrawTrust as a processor; (b) you have provided participants with all notices required by law; (c) the drawing is lawful in every jurisdiction in which participants reside; (d) any prize, eligibility rule, and selection rule you advertise is accurate and within your power to honor; and (e) you have all rights necessary to upload any content you provide.

You agree to defend, indemnify, and hold harmless DrawTrust and its officers, directors, employees, contractors, affiliates, and sub-processors from and against any and all claims, liabilities, damages, losses, fines, judgments, settlements, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) the participant data you provide or the manner in which you obtained it; (ii) the conduct, advertising, eligibility, prize, or outcome of any drawing you create; (iii) any claim by a participant or third party in connection with the drawing; (iv) your violation of these Terms or of any law; or (v) your violation of any third-party right.

7. Intellectual property and content licence

DrawTrust owns all right, title, and interest in and to the Service, including the software, design, trademarks, logos, and documentation. You retain ownership of content you upload (participant lists, prize images, drawing titles, and similar). By submitting content you grant DrawTrust a worldwide, royalty-free, sub-licensable licence to host, store, process, transmit, display, modify, and format that content as necessary to operate, secure, and improve the Service, to create derivative anonymized or aggregated data, and to retain verification artifacts indefinitely as described in our Privacy Policy. You warrant that you own or have all rights necessary to grant this licence.

8. Verification and public data

When a drawing is created, its participant pool is hashed and sealed. The drawing's short code, status, and — depending on the visibility settings the organizer selects — participant count and winner information may be publicly accessible through the verification endpoint. Independent participant-side verification is the core purpose of the Service.

Verification is provided AS IS. DrawTrust does not warrant the accuracy, completeness, or legality of organizer-submitted identifiers, prize claims, or drawing rules. A successful verification confirms only that an identifier was present in the pool that was sealed at the time the drawing closed; it does not confirm any further fact about the participant, the prize, or the organizer.

9. Social platform connections

If you connect a social account (for example YouTube, Instagram, Facebook, or X) you authorize DrawTrust to access the relevant platform's API on your behalf, within the granted scopes, to fetch comments, posts, or related metadata for your drawings. You may disconnect at any time from the Connections page; disconnection does not affect drawings already created. Your use of any third-party platform remains subject to that platform's own terms and policies, and DrawTrust is not responsible for any change, restriction, or termination by a third-party platform.

10. Service availability and warranty disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRAWTRUST DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, FREEDOM FROM ERROR OR INTERRUPTION, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, DrawTrust does not warrant: (a) that the Service will be uninterrupted, timely, secure, or error-free; (b) the accuracy or completeness of any participant identifier or pool; (c) that the Service is suitable for any particular type of drawing or fits any organizer's specific regulatory or contractual requirements; or (d) that the Service is compliant with the law of every jurisdiction where it is accessed.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRAWTRUST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SUB-PROCESSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event will DrawTrust's total aggregate liability arising out of or related to these Terms or the Service, whether in contract, tort, statute, or otherwise, exceed the greater of (a) the amounts you paid to DrawTrust for the Service in the twelve months preceding the event giving rise to the claim or (b) one hundred United States dollars (USD 100).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, fraud, or — where applicable — death or personal injury caused by negligence.

12. Suspension and termination

You may delete your account at any time. DrawTrust may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, with or without cause, including for suspected violation of these Terms, suspected fraud or abuse, security concerns, regulatory inquiry, payment failure, or operational discretion. On termination your right to use the Service ceases immediately.

Provisions that by their nature should survive termination — including sections 6 (Organizer warranties and indemnification), 7 (Intellectual property and content licence), 10 (Warranty disclaimers), 11 (Limitation of liability), 15 (Governing law and dispute resolution), and 16 (General), and the indefinite-retention rules in our Privacy Policy — survive termination.

13. Modifications to the Service and to these Terms

DrawTrust may modify, suspend, or discontinue any feature, pricing, or aspect of the Service at any time, in whole or in part, without liability. We may update these Terms from time to time. For material updates we will post the revised Terms on this page with a new "Last updated" date and provide reasonable in-app notice. Immaterial updates — clarifications, formatting, or contact updates — may take effect immediately. Updates required for legal or regulatory compliance take effect immediately. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Force majeure

DrawTrust is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, war or armed conflict, civil unrest, terrorism, governmental action, sanctions, currency or banking disruption, regional infrastructure or telecommunications failure, internet or hosting-provider outage, third-party service failure, labor disturbance, pandemic, or public-health emergency.

15. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Lebanese Republic, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute, controversy, or claim arising out of or in connection with these Terms or the Service, including any question regarding their existence, validity, or termination, will be resolved exclusively by the competent courts sitting in Beirut, Lebanon — or, at DrawTrust's sole election, by binding arbitration seated in Beirut conducted under the rules of a recognized arbitration institution selected by DrawTrust, in English, by a single arbitrator.

Class-action and collective-action waiver: to the maximum extent permitted by applicable law, you and DrawTrust each agree that any claim must be brought in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Mandatory rights of consumers under Lebanese law or, where applicable, the law of the consumer's habitual residence in the EEA, that cannot be waived by contract, are unaffected.

16. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DrawTrust regarding the Service and supersede all prior agreements on that subject. If any provision is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be modified to the minimum extent necessary to make it enforceable. No waiver of any provision is effective unless in writing and signed by DrawTrust, and no failure to enforce any provision is a waiver of that provision. You may not assign or transfer these Terms or any rights under them without our prior written consent; DrawTrust may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets. Notices to DrawTrust must be sent to the contact address below; we may give notice to you by email to the address on file or by in-app notice.
